1. Product Description & Quality Standards

• Accuracy & Updates: We do our best to ensure that we update our information regularly.

• Substitutions: If any piece of jewellery, diamond, or gemstone becomes unavailable after you ordered it, we will contact you immediately to find a replacement of similar or better quality. We will never substitute your order for anything of lesser quality than stated.

• Expertise: Our experts are GIA certified, with higher grading standards than many in the industry, ensuring maximum beauty and quality within your budget.

2. Product Representation & Availability Disclaimer

• Visual Accuracy: We make all possible efforts to display products accurately. However, colors and images may appear differently on various digital devices and cellular phones due to display capabilities.

• Warranties: While we strive for accuracy, we do not warrant that product descriptions, pricing, or other content are accurate, complete, reliable, current, or error-free.

• Pricing Errors: In the rare case of a pricing error or change discovered after payment, Design Jewellers has the full right to cancel the sale and refund the transaction without additional legal or financial liability.

• Exclusivity: Certain products or services may be exclusive to the website, while others may be exclusive to our physical store.

• Availability: We cannot always guarantee availability or turnaround times. We reserve the right to limit quantities, change pricing without notice, or discontinue any product at our sole discretion.

3. Possible Errors & Inaccuracies

• Corrections: Occasionally, site information may contain typographical errors, inaccuracies, or omissions regarding descriptions, pricing, promotions, shipping charges, and transit times.

• Right to Update: We reserve the right to correct any errors and change information or cancel orders at any time without prior notice, including after an order is submitted.

• Maintenance: We undertake no obligation to update or clarify information (including pricing) except as required by law. No refresh date on the site should be taken to indicate all information is updated. Any errors are unintentional and will be resolved to the best of our ability without legal liability.

4. Payment Terms & Security

• Processing: International payment processing is handled through our designated service providers. By ordering, you agree to these terms and acknowledge that transactions are subject to gateway verification.

• User Responsibility: You promise all provided information is truthful and accurate. You are strictly responsible for monitoring your account activity and maintaining the security of your personal information. We are not liable for any secondary users or unauthorized access to your information.

• Personal Use: Products are for personal use only and not for reselling or marketing.

• Jurisdiction: All payments are under the jurisdiction laws of Alberta, Canada, and subject to provincial fees/taxes.

• Order Fulfillment: Orders are typically prepared within 24-48 hours after payment, provided there are no unforeseen interruptions.

• Account Accuracy: You agree to provide current, complete, and accurate purchase and account information (email, credit card numbers, expiration dates) to ensure successful transactions.

• FINTRAC Policy: We adhere to strict FINTRAC policies. For purchases exceeding $10,000, additional information may be required before shipping. (FINTRAC Requirements)

5. Shipping & International Orders

• Shipping Contract: All items are made pursuant to a shipment contract. Once an item leaves our physical location, it is out of our control and we are not liable for loss or damages.

• Delivery Rules: We will not ship to P.O. Boxes. All parcels include tracking and require a signature upon receipt.

• Arrangements: For special shipping arrangements or in-store pickup, you must notify us at the time of order or no later than 24 hours after.

• International Clients: International shipments may be subject to custom duties, taxes and tariffs or other import charges imposed by the destination jurisdiction. Please be advised these charges are not included in Design Jewellers and Diamonds prices or shipping fees and are the sole responsibility of the purchaser, who is advised to review applicable import requirements of their country.  

6. Cancellations & Return Policy

• Cancellations: You must notify us in writing via email within 24 hours. It is your responsibility to follow up with a phone call to confirm receipt of the cancellation. After 24 hours, orders cannot be cancelled.

• Custom Orders: Every order is specifically customized and hand-crafted. Therefore, special and customized orders are final and non-refundable.

• Inspection: All items are meticulously inspected by quality control before shipping. Concerns must be addressed within 24 hours of receiving the item.

• Exchanges: Non-specialty items may be exchanged at our discretion within 14 days. These are subject to a 20% restocking fee. Items must be brand new, unused, with original tags, labels, receipts, and paperwork.

• Shipping Returns: Due to fraudulent return risks, we cannot accept items containing diamonds or gemstones via mail. You must contact us to arrange a physical hand-over at our store location. If shipping an allowed item for exchange, we advise using a trackable service with insurance; we do not guarantee receipt of returned items.

7. Privacy Policy & Data Use

• Data Collection: We collect Personal Data (email, name, phone, address) and Usage Data (IP address, browser type, diagnostic data) to provide and improve our service.

• Cookies: We use cookies and tracking technologies (beacons, tags) for security and service analysis. You may refuse cookies, but some site functions may be limited.

• Data Transfers: Your data may be transferred to and processed in Canada. We take all reasonable steps to ensure data is treated securely, though no internet transmission is 100% secure.

• Third Parties: We may employ third-party Service Providers and use Google Analytics to monitor website traffic. You can opt-out of Google Analytics by installing their browser add-on.

• Updates: The Privacy Policy may be updated periodically; you are advised to review it regularly.

8. Disclaimer of Warranty & Limitation of Liability

• "As Is" Basis: All materials and products are provided on an "as is" and "as available" basis without any express or implied warranties.

• Risk: Your use of the site is at your own risk. You waive Design Jewellers & Diamonds Ltd. from any legal liabilities, including indirect, incidental, punitive, or consequential damages.

• Service Reliability: We do not guarantee that service will be uninterrupted, timely, or error-free. We may remove or cancel the service at any time without notice.

• Indemnification: You agree to defend and hold harmless Design Jewellers & Diamonds Ltd. (and its affiliates, directors, and employees) from any claims, lawsuits, or legal fees arising from your use of the site or breach of these terms.

9. Intellectual Property & Prohibited Uses

• Ownership: All text, graphics, logos, images, and video are the property of Design Jewellers & Diamonds Ltd. and protected by international copyright laws.

• Usage Restrictions: Content is for personal, non-commercial use only. You may not reproduce, modify, distribute, or commercially exploit the content without written permission.

• Prohibitions: You are prohibited from using the site for unlawful purposes, infringing on intellectual property, transmitting viruses, or harassing/discriminating against others. Violation will result in immediate termination of services.

10. Termination & Disputes

• Termination: These terms are effective until terminated by either party. We may terminate this agreement at any time without notice if you fail to comply with any provision.

• Dispute Resolution: Any disputes must first be resolved through negotiation. If necessary, legal escalation will be held under the jurisdiction of Alberta, Canada.

• Severability: If any provision is determined to be unlawful or unenforceable, that portion shall be severed, and the remaining provisions shall remain in full force.
